Gradient's Privacy Policy

Introduction

This Privacy Policy governs the collection, use, and sharing of personal information by Gradient, a Discord bot developed by Jeremy L. ("we", "us", "our"). By using Gradient, you agree to the terms of this Privacy Policy.

When you use our bot, Gradient (the "Bot" or the "Service"), we appreciate that you are trusting us with your information. We take your privacy very seriously. In this Privacy Policy, we seek to explain to you in the clearest way possible what information we collect, how we use it and what rights you have in relation to it. We hope you take some time to read through it carefully, as it is important. If there are any terms in this Privacy Policy that you do not agree with, please discontinue use of the Service immediately.

This Privacy Policy applies to all information collected through the Service (which, as described above, includes the Bot), as well as any related services or events.


Information We Collect

In short: We collect information that you provide to us.

We collect information that you voluntarily provide to us when you use a command with the Bot or participate in activities using the Bot, or express an interest in obtaining information about us or the Service.

The information that we collect depends on the context of your interactions with us and the Bot, the choices you make and the products and features you use.

We will never collect your real name, date of birth, gender, race, and location, unless you voluntarily provide us with this information by using a corresponding Bot command.

The Bot may collect the following data from you:

  • Discord username and ID
  • Your live Discord presence (only if you voluntarily opt in*)
    Please note that your presence may only be stored with your consent within any mutual servers shared between you and the bot that have the presence role feature enabled. If you opt out of this feature, your presence roles will not be updated by the bot.

The Bot may collect the following data from you within all mutual Discord servers shared between you and the Bot:

  • Message content
  • Inputs from Discord's built-in buttons and forms
  • Emoji reactions to messages (only if you opt in*, and only when you react to a message in a server with ⭐ when starboard is enabled for that server, 🎉 when a giveaway is ongoing in that server, number characters when a poll is ongoing in that server, or a Unicode emoji configured with an active reaction role system in that server)

The Bot may collect the following data from your Discord server:

  • Server name and ID
  • Server categories and channels
  • Server roles
  • Server permissions
  • Server emojis

How We Use Your Information

In short: We use your information to operate and improve the Service, including to provide support and respond to your requests. We may also use your information to develop new features or services, to conduct research and analytics, and to comply with legal obligations.

We will never use your real name, date of birth, gender, race, and location, unless you voluntarily expose this information by using a corresponding Bot command.

The bot uses the information collected and/or stored for the following purposes:

  • User information:
    • Any command that requires the checking or display of a username or ID
    • User information commands
    • Moderation commands and functionality
    • Welcome messages
    • Birthday announcements
    • Calendar notifications
    • Timer notifications
    • User verification system upon joining a server
    • Support ticket system
    • Economy account (if applicable)
    • Presence role system (only if you voluntarily opt in*)
    • Starboard
    • Emoji counter
    • Limit or modify the methods used to process parts of your data, depending on your stored settings
  • Server information:
    • Any command that requires the checking or display of a server name or ID
    • Prefix configuration
    • Disabling Bot commands
    • Logging
    • Welcome messages
    • Giveaways and polls
    • Level role system
    • Reaction role system
  • Message information:
    • Command execution
    • Content moderation (profanities, unsafe links, invites, spam, etc.)

Sharing Your Information

In short: We do not sell or share your personal information with third parties. However, we may disclose your information in response to legal process or a request from a law enforcement agency or regulatory authority.

However, since most data collected, stored, and used by the Bot is publicly available to all users who share a mutual server with you (eg. usernames/IDs), we cannot control, and we do not assume any responsibility for, the sharing of any of said publicly available data through the Discord platform.

In addition, we cannot control, and we do not assume any responsibility for, information that may be separately collected by third party service providers. The information collected by third parties is different from the information collected by the Service, and we do not have access to nor control over most of this information. It is strongly advised to read Section 14 of this Privacy Policy for more details regarding the data collection practices of third parties, as well as for instructions on how to opt out of applicable data-collecting third parties. If there are any terms in the data collection policies of these third parties that you do not agree with, please discontinue use of our Services immediately.


Data Retention

In short: We retain your information for as long as necessary to provide Gradient's services or as required by law. We will delete your information upon your request or when it is no longer needed.

We will never store your real name, date of birth, gender, race, and location, unless you voluntarily provide us with this information by using a corresponding Bot command.

When we have no ongoing legitimate business need to process your information, we will either delete or anonymize such information, or, if this is not possible (for example, because your information has been stored in backup archives), then we will securely store your information and isolate it from any further processing until deletion is possible.


Data Security

In short: We take reasonable measures to protect your information from unauthorized access, alteration, or destruction. However, no security measure is perfect, and we cannot guarantee the security of your information.

We have implemented appropriate technical and organizational security measures designed to protect the security of any information that we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security, and improperly collect, access, steal, or modify your information. Although we will do our best to protect your information, transmission of personal information to and from the Bot via the Discord software is at your own risk. You should only access the Bot, and subsequently the Discord software, within a secure environment.


Privacy Rights

In short: You have rights that allow you to control your personal information stored with the Bot. You may review or modify your stored information with the Bot at any time.

You have certain rights under applicable data protection laws. These may include the right (i) to request access and obtain a copy of your personal information, (ii) to request rectification or erasure; (iii) to restrict the processing of your personal information; and (iv) if applicable, to data portability. In certain circumstances, you may also have the right to object to the processing of your personal information. To make such a request, please use the contact details provided below. We will consider and act upon any request in accordance with applicable data protection laws.

If we are relying on your consent to process your personal information, you have the right to withdraw your consent at any time. Please note, however, that this will not affect the lawfulness of the processing before its withdrawal, nor will it affect the processing of your personal information conducted in reliance on lawful processing grounds other than consent.


Legal basis for processing personal data under the General Data Protection Regulation (GDPR):

We are compliant with the General Data Protection Regulation (GDPR). If you are from the European Economic Area (EEA), our legal basis for collecting and using the personal information described in this Privacy Policy depends on the personal data we collect and the specific context in which we collect it. We may process your personal data because:

  • We need to perform a contract with you
  • You have given us permission to do so
  • The processing is in our legitimate interests and it is not overridden by your rights
  • To comply with the law

Your data protection rights under the General Data Protection Regulation (GDPR):

We are compliant with the General Data Protection Regulation (GDPR). If you are from the European Economic Area (EEA), we aim to take reasonable steps to allow you to request, amend, delete, or limit the use of your personal data. Please note we may ask you to verify your identity before responding to such requests.

In certain circumstances, you have the following data protection rights:

  • The right to access and update your information stored in the bot. Whenever possible, you can access and update your data through using the appropriate Bot commands.
  • The right to delete your information stored in the bot. Please read Section 9 of this Privacy Policy for more details.
  • The right to rectification. You have the right to have your information rectified if that information is inaccurate or incomplete.
  • The right of restriction. You have the right to request that we restrict the processing of your personal information.
  • The right to data portability. You have the right to be provided with a copy of the information we have on you in a structured, machine-readable and commonly used format.
  • The right to withdraw consent. You also have the right to withdraw your consent at any time where we relied on your consent to process your personal information.

Data Deletion

In short: In compliance with the GDPR, you are allowed to freely delete any part or all of your data stored with the Bot. In addition, the Bot will automatically delete stored message data if specific conditions have been met.

The Bot will automatically delete stored message data one day (24 hours) after the time at which said message data collected.

The following methods can be used to delete some or all of your stored data with the Bot:

  • To manually delete stored message data, use the cleardeleted, clearedited, and clearmessages commands with the Bot.
  • To manually delete stored message data, use the cleardeleted, clearedited, and clearmessages commands with the Bot.
  • To delete your message history within the bot's support ticketing system, use .ticket close [ticket ID] in a direct message channel with the bot. However, this will adversely impact our ability to assist you with your issue.
  • To reset your XP and level, use the resetxp command with the Bot.
  • To reset your coins, use the resetcoins command with the Bot.
  • To reset your items, use the resetitems command with the Bot.
  • To completely delete your economy account, use the deleteaccount command with the Bot.
  • To delete all of your data stored in the Bot and reset all of your sessions in the Bot's services, use the cleardata command with the Bot.
  • To delete all server-related data collected, remove the Bot from your server.
  • To delete any other piece of your data, please file a support ticket using an alternative method.

Opting In/Out

In short: When using specific Bot features that may store parts of your personal data, you have the ability to indicate to us whether or not you would like us to store said components of said personal data.

  • For the tracking and storage of your messages and presences, as well as the tracking of your reactions, you can opt in/out of these features at any time using the settings command with the Bot.
  • If you would like the Bot to stop collecting data from you completely and permanently, you can opt out of the usage of the Bot using the optout command with the Bot. However, please note that this action cannot be undone via the Discord software. If you would like to resume usage of our Services after fully opting out, please file a support ticket using an alternative method.

In addition, please note that you will be unable to access certain services provided by the Bot if you opt out of data collection.


Data Transfer

In short: Your information, including personal information, may be transferred to - and maintained on - computers located outside of your state, province, country or other governmental jurisdiction, where the data protection laws may differ from those of your jurisdiction.

If you are located outside the United States and Canada and choose to provide information to us, please note that we transfer the data, including personal data, to the United States and/or Canada and process it there.

Your consent to this Privacy Policy represents your agreement to this transfer.

We will take all the steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy, and no transfer of your data will take place to an organization or a country unless there are adequate controls in place including the security of your data.


Children's Privacy

In short: Our Service is not intended to be accessed by anyone under the age of 13 ("Children", "Child").

Since it is against Discord's Terms of Service for children to register for a Discord account, and subsequently be able to use the Bot, we do not knowingly collect personally identifiable information from anyone under the age of 13. If we become aware that we have collected personal data from Children without verification of parental consent, we will take steps to remove that information from our databases in accordance with the Children's Online Privacy Protection Act (COPPA).

If you are a parent or guardian and you are aware that your Child has provided us with personal data, please file a support ticket as soon as possible and we will take steps to remove your Child's data.


Third-Party Service Providers

In short: We may employ third party companies and individuals to facilitate our Service ("Service Providers"), provide the Service on our behalf, perform Service-related services or assist us in analyzing how our Service is used.

These third parties have access to your data only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose. However, please note that the types of data collected by these third parties are different from that collected by this Service, and we do not assume any responsibility for, how the data collected by these third parties may be used by these third parties. As such, it is advised to read the separate privacy policies of these third parties, found below. If there are any terms in the privacy policies of these third parties that you do not agree with, please discontinue use of our Service immediately.


Target Platform — Discord

Discord is a VoIP, instant messaging and digital distribution platform designed for creating communities. Users communicate with voice calls, video calls, text messaging, media and files in private chats or as part of communities.

Analytics — Google Analytics

Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of our website. This data is shared with other Google services. Google may use the collected data to contextualize and personalize the ads of its own advertising network.

You can opt-out of having made your activity on the website available to Google Analytics by installing the Google Analytics opt-out browser add-on. The add-on prevents the Google Analytics JavaScript (ga.js, analytics.js, and dc.js) from sharing information with Google Analytics about visits activity.

Changes to this Policy

In short: Yes, we will update this policy as necessary to stay compliant with relevant laws.

We may update this Privacy Policy from time to time. The updated version will be indicated by a "Last Updated" date. If we make material changes to this Privacy Policy, we may notify you by prominently posting a notice of such changes. We encourage you to review this Policy frequently to be informed of how we are protecting your information.

Your continued use of the Bot after we make changes to this Privacy Policy indicates your acceptance of the revised Policy.
